Inmigración y castigo: Contra las leyes de inadmisibilidad penal

¿Son justificables desde un punto de vista moral las leyes que prohíben el ingreso de extranjeros a un Estado en virtud del historial penal de estos individuos? Tomando como punto de partida los argumentos recientes de Cécile Fabre (2016) contra el uso de este tipo de leyes o criterios de inadmisibilidad por parte de Joseph Carens (2013), descarto una serie de posibles objeciones contra este criterio y ofrezco una crítica normative distinta y sustantiva contra esta forma de inadmisibilidad migratoria. Esta crítica se funda en el principio de igualdad en la base de cualquier teoría política plausible que, consecuentemente, debe ser parte de una comprensión adecuada de la pena dentro de una comunidad política. De lo anterior concluyo que el criterio de inadmisibilidad penal es injustificable dentro de una comunidad política que aspira a respetar el igual estatus moral de todos los individuos.
