En este artículo se analiza la industria del amparo fiscal en México. Se trata de una industria exitosa y floreciente que se ha establecido a partir de una interpretación “garantista” del artículo 31 de la Constitución. Esta interpretación permite disputar en el Poder Judicial la constitucionalidad de las leyes tributarias. Se trata de una protección al contribuyente por parte de la justicia, la cual no existe con esta amplitud en los países miembros de la ocde y probablemente en el mundo. El amparo en materia fiscal y la industria surgida bajo su sombra no sólo erosiona la capacidad de recaudación del gobierno, sino la legitimidad del cobro de impuestos, ya que los amparados pagan menos impuestos respecto a quienes no logran la protección de la justicia. El artículo analiza por qué surge esta industria, cuánto vale, qué implicaciones tiene y cómo se puede tratar de cambiar.
